Terms of Service
1. Acceptance of terms
PostandBid LLC ("PostandBid," "we," "us," or "our") operates an online marketplace connecting homeowners with independent contractors. These Terms of Service form a legally binding agreement between you and PostandBid. By creating an account or using the platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Nature of the platform
PostandBid is a marketplace only. We do not perform home improvement work, employ contractors, or act as a general contractor. All service contracts are formed directly between homeowners and independent contractors. PostandBid is not a party to those agreements and is not responsible for the quality, safety, completion, or any other aspect of the work performed.
3. Eligibility
You must be at least 18 years old, reside in the United States, and have the legal capacity to enter into binding contracts to use PostandBid. You may not use PostandBid if you have been previously suspended or removed from the platform. PostandBid does not knowingly collect personal information from anyone under the age of 13 in compliance with the Children's Online Privacy Protection Act (COPPA).
4. Accounts
- You must provide accurate and complete information when creating an account.
- You may maintain only one account per person per account type.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- Creating multiple accounts to evade restrictions, suspensions, or bans is prohibited and may result in permanent removal from the platform.
- You agree to notify us immediately at support@postandbid.com if you suspect any unauthorised use of your account.
5. Homeowner terms
- You are responsible for providing accurate, honest, and complete project descriptions.
- You must be the owner of the property or be authorised to commission work on it.
- Accepting a bid creates a direct contract between you and the contractor. PostandBid is not a party to that agreement.
- You must conduct your own due diligence before hiring any contractor, including independently verifying their licences, insurance, and references.
- Reviews must be honest, accurate, and based on genuine first-hand experience. Fake, incentivised, or retaliatory reviews are prohibited.
- PostandBid reserves the right to suspend or permanently remove homeowners who post false or misleading project descriptions, leave fraudulent or retaliatory reviews, repeatedly decline bids without genuine cause, or otherwise act in bad faith toward contractors or the platform.
6. Contractor terms
- Contractors are independent third parties, not employees, partners, or agents of PostandBid. You are solely responsible for your work, licensing, insurance, taxes, and legal compliance.
- By placing a bid, you represent that you are qualified, licenced where required, and genuinely available to perform the work described.
- Your bid amount must be a genuine and considered estimate of the cost to complete the described work.
- Contractors who accept a bid and fail to perform the work without reasonable notice to the homeowner may be suspended or permanently removed from the platform.
- You agree to maintain professional standards in all communications and work performed through PostandBid, including responding to messages in a timely manner and honouring accepted bids.
7. Payments and refunds
- All payments are processed via Stripe, a third-party payment processor. By making a payment you also agree to Stripe's terms of service. PostandBid does not store your full card details.
- All payments are processed on the PostandBid website (postandbid.com) only. No payments are processed within any mobile application.
- Posting fees and subscription fees are generally non-refundable.
- Homeowners may request a full refund of the posting fee if their project receives zero bids within 14 days of posting by contacting support@postandbid.com.
- Refunds are not available for projects that receive one or more bids, regardless of whether the homeowner proceeds with any of them.
- PostandBid does not process, handle, or mediate payments between homeowners and contractors for the actual work performed. Those transactions are entirely private between the two parties.
8. Contractor credentials
PostandBid does not verify licences, insurance certificates, or any other contractor credentials. All credentials displayed on the platform are self-reported by contractors and are clearly labelled as such.
Homeowners are solely responsible for independently verifying any contractor's qualifications, licences, and insurance before allowing work to begin on their property. PostandBid makes no representation or warranty regarding the accuracy of any contractor's stated credentials.
9. Content and conduct
- By posting content on PostandBid you grant PostandBid a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content for the purpose of operating the platform. You retain ownership of your content.
- You agree not to post content that is false, misleading, harassing, hateful, sexually explicit, violent, illegal, or otherwise inappropriate.
- Off-platform solicitation — sharing personal contact information such as phone numbers or email addresses to bypass PostandBid's platform — is prohibited.
- PostandBid operates a three-strike policy for language violations. A first violation results in content removal and a warning. A second violation within a rolling six-month period results in a 48-hour suspension. A third violation results in account suspension pending human review. Targeted harassment, hate speech, or slurs bypass the strike system and may result in immediate permanent removal.
- Uploading sexually explicit, violent, or otherwise inappropriate images is a zero-tolerance violation. Accounts found to have uploaded such content will be immediately suspended pending human review. Confirmed violations result in permanent removal from the platform. No refunds of any posting fees, subscription fees, or bid credits will be issued in cases of confirmed inappropriate image violations — misuse of the platform forfeits any right to reimbursement.
- PostandBid reserves the right to remove any content that violates these Terms without notice.
10. Dispute resolution
Disputes between users
PostandBid provides tools to facilitate communication between homeowners and contractors in the event of a dispute. We do not adjudicate disputes, determine fault, issue rulings, or compel either party to take any particular action. PostandBid is not a party to disputes between users and assumes no liability for their outcomes.
Disputes with PostandBid
Any dispute between a user and PostandBid will first attempt informal resolution by contacting us at support@postandbid.com. If unresolved, disputes will be settled through binding arbitration in King County, Washington, under the rules of the American Arbitration Association.
11. Limitation of liability
To the fullest extent permitted by law, PostandBid is not liable for the quality, safety, legality, or completion of any work performed by contractors; any property damage or personal injury arising from contractor work; or any indirect, incidental, special, consequential, or punitive damages of any kind.
PostandBid's total liability to you for any claim is limited to the greater of $100 or the total amount you paid PostandBid in the 12 months preceding the claim.
The platform is provided on an "as is" and "as available" basis with no warranties of any kind, either express or implied.
PostandBid makes no guarantee that any project listing will receive bids, that bids received will meet a homeowner's budget expectations, or that any contractor will be available in a homeowner's area. The posting fee covers access to the platform only — it does not guarantee any particular outcome or level of contractor interest.
12. Intellectual property
PostandBid's name, logo, platform design, and all associated intellectual property are owned by PostandBid LLC. You may not use, reproduce, or distribute any PostandBid branding or content without prior written permission. Nothing in these Terms grants you any licence to use PostandBid's intellectual property except as strictly necessary to use the platform.
13. Force majeure
PostandBid is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, power failures, acts of government, pandemics, or other events outside our control.
14. Termination
PostandBid reserves the right to suspend or terminate accounts at any time for violations of these Terms, conduct harmful to the platform or its users, or for any other reason at our sole discretion. You may close your account at any time by contacting support@postandbid.com. Closing your account does not entitle you to a refund of any unused credits or fees except as required by applicable law.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
16. Changes to terms and governing law
We may update these Terms at any time. We will notify registered users of material changes by email or prominent notice on the platform at least 14 days before changes take effect. Continued use of PostandBid after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Washington, United States. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in King County, Washington.
